The decision to grant or refuse a Bail Application is at the discretion of a judicial officer.
Part C of Schedule 1 of the Bail Act 1982 (WA) sets out the principles governing grant or refusal of bail. These include matters set out under Clauses 1 to 3 Part C of Schedule 1 of the Bail Act generally:-
(a) whether, if the accused is not kept in custody, he may:
(i) fail to appear in court in accordance with his bail undertaking;
(ii) commit an offence;
(iii) endanger the safety, welfare, or property of any person; or
(iv) interfere with witnesses or otherwise obstruct the course of justice, whether in relation to himself or any other person;
(b) whether the accused needs to be held in custody for his own protection
